Terms of Service

These Terms of Service form a binding agreement between you and Infinitum Imagery LLC (“Infinitum,” “we,” “us,” or “our”) governing Ackvio and its websites, applications, APIs, email-provider connections, and related services (the “Service”). By creating an account, clicking acceptance, connecting a provider, or using the Service, you agree to these Terms and acknowledge the Privacy Policy.

Eligibility and authority

You must be at least 18 years old and legally capable of entering a contract. If you use Ackvio for an organization, you represent that you are authorized to bind that organization, and “you” includes it. You must provide accurate account information and keep it current.

Ackvio accounts and mailbox connections

Your Ackvio identity is managed through Firebase Authentication and is separate from any mailbox you connect. You are responsible for safeguarding login credentials, provider accounts, devices, API keys, and sessions, and for activity under your account. Notify us promptly of suspected unauthorized use. You may connect only accounts you own or are expressly authorized to administer.

The Service

Ackvio may provide tracked email sending, scheduled batch delivery, Engagement Signals, Click Intelligence, Engagement Timelines, Follow-up Signals, Activity Digests, unsubscribe assistance, multiple-mailbox management, APIs, webhooks, CRM connections, and administrative tools. These signals can be affected by image blocking, forwarding, privacy proxies, caching, and automated scanners and are not proof that a particular person viewed a message. Features, limits, supported providers, and availability vary by plan and may change. A listed future or preview capability is not guaranteed until identified as generally available.

Your responsibilities for email and tracking

You are solely responsible for the recipients, content, legal basis, notices, consent, and configuration of messages sent through Ackvio. You must comply with privacy, electronic communications, marketing, anti-spam, employment, consumer-protection, and industry rules applicable to you and your recipients. Where required, you must disclose the use of tracking pixels, redirect links, analytics, or automated processing and obtain valid consent. Ackvio is not legal advice and does not determine whether your use is lawful.

Acceptable use

You may not use the Service for spam, purchased or unlawfully obtained lists, phishing, fraud, impersonation, harassment, malware, credential collection, unlawful surveillance, discrimination, deceptive tracking, infringement, prohibited content, sanctions evasion, or activity that threatens people, networks, providers, or the Service. You may not bypass plan limits, conceal abusive traffic, probe or disrupt security, scrape nonpublic data, reverse engineer except where law expressly permits it, resell the Service without permission, or use it to develop a substantially similar competing service through unauthorized access.

Inbox cleanup assistance

Ackvio may analyze sender lists locally and surface cleanup candidates. Current local and on-device modes do not directly delete, archive, report, block, or unsubscribe from provider mail. You are responsible for reviewing each suggestion and completing any mailbox or sender action through your provider. Results are advisory and may be incomplete or inaccurate.

Tracking limitations

Open and click signals may be missing, duplicated, delayed, or affected by image blocking, caching, privacy proxies, forwarding, security scanners, bots, and provider behavior. A signal is not proof that a specific human read, understood, or personally clicked a message. You must not use Ackvio activity as the sole basis for high-impact employment, credit, housing, insurance, health, legal, or similar decisions.

Scheduled sending and provider limits

Scheduled and batch delivery times are estimates. Ackvio may pace, retry, pause, suppress, or stop messages to honor recipient opt-outs, plan limits, provider responses, abuse controls, and operational safeguards. Provider limits may be lower than Ackvio’s configurable ceiling, may use rolling windows, and may include messages sent outside Ackvio. You remain responsible for list quality, sender reputation, authentication, and compliance. Messages already accepted by a provider generally cannot be recalled.

Third-party services

The Service relies on Firebase, Google Cloud, email providers, and other third parties. Their separate terms and privacy policies apply. You authorize Ackvio to request and use only the permissions you approve for connected services. We are not responsible for third-party outages, policy changes, account restrictions, data handling, or decisions to reject, filter, delay, or block messages.

Your content and instructions

You retain ownership of content and data you provide. You grant us a limited, worldwide, nonexclusive license to host, process, transmit, modify for technical formatting, and otherwise use that content only as reasonably necessary to provide, secure, support, and improve the Service or comply with law. You represent that you have all rights and permissions needed for the content and instructions you provide.

Plans, billing, and taxes

Plan features and prices are shown before purchase. If recurring billing is enabled, subscriptions renew for the stated period until canceled, and you authorize the disclosed charges and applicable taxes. Changes ordinarily take effect at the next billing period unless stated otherwise. Except where law requires, fees are nonrefundable and partial periods are not credited. Provider usage limits may apply independently of Ackvio plan limits.

Referral program

Eligible Ackvio account holders may share their assigned referral link. Ackvio credits a commission equal to 5% of subscription revenue actually collected from an attributed subscriber, excluding taxes and after discounts, credits, refunds, disputes, and chargebacks. Attribution applies only when a new account uses the referral link before creating its Ackvio workspace; self-referrals, duplicate accounts, fraudulent traffic, paid-search impersonation, spam, misleading promotion, and attempts to manipulate attribution are prohibited. Commissions are held for 30 days and may be reversed for refunds, disputes, fraud, billing corrections, or violations. A payout may be requested only when the available balance is at least US$50. Payouts are reviewed and may require identity, tax, or payment information; you are responsible for taxes on referral income. We may suspend, adjust, or end the program prospectively, but valid earned balances remain subject to these terms and applicable law.

Intellectual property and feedback

The Service, software, interfaces, documentation, trademarks, designs, and non-user content are owned by Infinitum Imagery LLC or its licensors and protected by law. No rights are granted except the limited right to use the Service under these Terms. If you provide feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation.

Confidential and beta features

Nonpublic credentials, security information, private documentation, and unreleased features are confidential. Preview, beta, or early-access features may be incomplete, changed, suspended, or removed and are provided without service-level commitments.

Suspension and termination

You may stop using Ackvio at any time. We may limit, suspend, or terminate access to address abuse, security risk, legal requirements, provider demands, nonpayment, or violations of these Terms. Sections that by nature should survive—including payment obligations, intellectual property, disclaimers, limitations, and indemnity—remain effective after termination.

Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted availability, deliverability, accuracy, and results. We do not warrant that tracking signals, unsubscribe requests, reminders, reports, integrations, or third-party services will be complete, error-free, or suitable for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, Infinitum Imagery LLC and its owners, personnel, affiliates, and suppliers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, lost profits, lost revenue, business interruption, reputational harm, loss of data, or unauthorized third-party conduct. Our aggregate liability arising from the Service will not exceed the greater of $100 or the amount you paid us for the Service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so these limits apply only to the extent permitted.

Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Infinitum Imagery LLC and its owners, personnel, affiliates, and suppliers from claims, losses, liabilities, damages, judgments, penalties, and reasonable costs arising from your content, recipients, provider accounts, violation of law, violation of these Terms, or misuse of the Service.

Governing terms

Applicable law may provide mandatory rights that these Terms cannot waive. Before filing a claim, each party agrees to attempt in good faith to resolve it by written notice and 30 days of informal discussion. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them with the Service or our business.

Changes

We may update these Terms to reflect legal, security, provider, or product changes. We will identify the effective version and, when required, request renewed acceptance. Material changes apply prospectively after notice, except urgent security or legal changes.
